Unless otherwise defined, terms with capital letters in this Disclaimer have the same meaning as in the General Terms and Conditions (available at https://bookyourbox.com/nl/page/algemene-voorwaarden).

In accordance with the limitations set out in our General Terms and Conditions and to the extent permitted by law, Book Your Box will only be liable for direct (and not indirect or consequential) damages actually incurred, paid or suffered by you due to a demonstrable failure on our part to fulfill our obligations with regard to our Service. This liability will in any case be limited to the amount paid by you to confirm your Reservation, which corresponds to the first month’s rent of the self-storage unit of your choice as determined in the confirmation email.

We or any of our directors shall not be liable to the fullest extent permitted by law for (i) any punitive, special, indirect or consequential damages, loss of production, loss of profit, loss of revenue, loss of contract, loss or damage to goodwill or reputation, loss of any claim, (ii) any inaccuracies in the (descriptive) information (including prices, availability, and ratings) of a Self-Storage Provider whose self-storage units are available through our Platform, (iii) the calculations (expressed in square meters (m²) and/or cubic meters (m³)) by the space calculator on our Platform, (iv) the services or products offered by a Self-Storage Provider, (v) any (direct or indirect, consequential or incidental) damages, losses or costs incurred or paid by you, whether arising from (legal) activities, resulting from, arising out of or in connection with the use, inability to use or delay of our Platform, or (vi) any (personal) injury, death, property damage or other (direct, indirect, special, consequential or incidental) damages, losses or costs incurred or paid by you, whether caused by (legal) activities, errors, breaches, (gross) negligence, intentional misconduct, omissions, non-performance, misrepresentation, tort or strict liability attributable to a Self-Storage Provider, whose services are directly or indirectly available, offered or promoted, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

Book Your Box is not responsible (and disclaims all liability) for the use, validity, quality, applicability, suitability, and proper disclosure of the Rental, and does not make any representations, warranties, or conditions of any kind in this regard, whether implied, statutory, or otherwise, including implied warranties of merchantability, title, non-infringement, or fitness for a particular purpose. You acknowledge and agree that the respective Landlord is solely responsible and assumes all responsibility and liability with respect to the Rental (including any warranties and representations of the Landlord). Book Your Box is not a (sub)lessor of the self-storage units made available on the Platform. Complaints or claims regarding the Rental must be directly submitted to the Landlord. Book Your Box is not responsible for and disclaims any liability with respect to such complaints, claims, and (product) liabilities.

You agree that the Landlord is always responsible for the remittance, collection, withholding, and payment of applicable taxes on the total amount of the Rental price to the relevant tax authorities, regardless of whether the Landlord has charged fees for your Rental, or whether we facilitate the payment of the Rental price. Book Your Box is not liable or responsible for remitting, collecting, withholding, or paying applicable taxes on the Rental price to the relevant tax authorities. Book Your Box will never act or operate as a seller and/or landlord for any product or service on the Platform.

Book Your Box does not own the uploaded photos/images and will not endorse them. The authenticity, validity, and right to use all photos/images lie with the person who uploaded the photo and are not the responsibility of Book Your Box. Book Your Box disclaims any responsibility and liability regarding the posted photos.
